This Is an agreement Between myself and CrossFit Imperative

Express assumption of risk: I, the undersigned, am aware that there are significant risks involved in all aspects of physical training. These risks include, but are not limited to: falls which can result in serious injury or death, injury or death due to negligence on the part of myself, my training partner, or other people around me, injury or death due to improper use or failure of equipment. I am aware that any of these above mentioned risks may result in serious injury or death to myself and or my partner(s). I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participation in any activity or class while at Crossfit imperative or under their instruction. I, the undersigned acknowledge that I have no physical impairments or illnesses that will endanger myself or others.


Release: In consideration of the above mentioned risks and hazards and in consideration of the fact that I am willingly and voluntarily participating in the activities available at Crossfit imperative, I, the undersigned hereby release Crossfit imperative, their principals, agents, employees, and volunteers from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in this activity, including those allegedly attributed to the negligent acts or omissions of Crossfit imperative, their principals, agents, employees, and volunteers. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect. If I am signing on behalf of a minor child, I also give full permission for any person connected with Crossfit imperative to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the well being of the child.


Indemnification: The participant recognizes that there is risk involved in the types of activities offered by Crossfit imperative. Therefore the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above mentioned parties, or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless Crossfit imperative, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by Crossfit imperative.


Rhabdomyolysis Release: Rhabdomyolysis (hereinafter referred to as "Rhabdo") can occur when an individual's physical activity is so intense that muscular cells begin to breakdown and the contents and/or remaining materials enter the bloodstream. Rhabdo may be caused by many other systemic or environmental causes. However, Exertional Rhabdo can occur in athletes of all levels of fitness, resulting in muscle cell destruction. The skeletal muscle breakdown impairs kidney function as those organs are unable to handle increased enzymes that are released into the bloodstream. This induces severe physiological changes in the body. The symptoms of Rhabdo include muscle pain, stiffness and extreme weakness, darkening of the urine (similar to the color of tea or cola), decreased urine output, altered mental status, swelling of the body part involved, either with or without pain. A Rhabdo symptom is pain out of proportion to the amount of soreness that one would generally expect, often producing pain much quicker than one would expect after a workout.

I, the undersigned, understand that any concerns on my part that I am experiencing any of the symptoms of Rhabdo require immediate presentation to a hospital for emergency treatment. I acknowledge that no third party, either from the facility or otherwise, will be capable of monitoring my urine output or color, and it is my responsibility to be continually cognizant of this symptom and all other symptoms and to monitor them in my own body at all times. I agree that I will remove myself from participation and seek medical treatment of my own accord should I have any concerns regarding possible symptoms of Rhabdo. I understand that statistically individuals most likely to experience Rhabdo are those who are in good shape by general standards or who were previously in good physical shape. This includes individuals who were prior athletes. I acknowledge that often the more mentally tough an athlete is and the more athletic they were in the past or currently are, the greater the risk of exposure to Rhabdo.

I, the undersigned, agree to monitor myself in a manner that is proportionate to the potential injury that can be occasioned by this condition. I acknowledge and understand that I am the only individual capable of determining if I am experiencing Rhabdo symptoms. I hereby agree and do willingly assume responsibility for any risks that I expose myself to and accept full responsibility for any injury or death that may result from participating in this significantly demanding physical activity. I for myself and on behalf of my heirs, assigns, personal representatives and/or next of kin, forever WAIVE, RELEASE, DISCHARGE and COVENANT NOT TO SUE and/or their officers, directors, representatives, partners, officials, principals, agents or employees, subsidiaries, or assigns, as well as their independent contractors.

I have read and understood the foregoing assumption of risk, and release of liability and I understand that by signing it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission. I understand that by signing this form I am waiving valuable legal rights. 


PARENTAL CONSENT, (for participants under the age of 18) I, the undersigned parent or legal guardian of the child shown above, have read the above and understood the foregoing assumption of risk, and release of liability and agree to its terms on behalf of my child and myself. I understand that by signing below, I am giving up substantial rights on behalf of my child and myself.

MEMBERSHIP AGREEMENT

All membership packages rates are per calendar month, paid monthly.

All persons wishing to become a member at the end of their On Ramp/Introductory will have the option to do so within 7 days of their session, should it be outside of the 7 day period they will not be able to claim back their fundamental payment of £30 against their membership.

2. Three-Day Right of Rescission
New members have three days after signing this Agreement to cancel their membership without penalty. If the Agreement is cancelled within three days, Crossfit imperative will return all amounts paid (Excluding fundamental payments as they are non refundable and in the same manner paid) within 30 days after cancellation. If original payment was by credit card, the amount paid will be credited to the card used for the original transaction. To cancel, new members must email, Crossfit imperative and inform Crossfit imperative of their wishes to cancel.

3. Freeze Policy
There is no option to put a freeze on a membership, should you wish to take time out of your agreement you must give 2 full membership months notice and then rejoin once the period you wish to miss is over.

4. Payments
All payments are due on or before the date of which your agreement has started, the payment due will be of the amount that is set for the membership option you have chosen. These payments cannot be changed unless prior authorisation is give by E-mail from an agent of Crossfit Imperative from the E-mail flynn@crossfitimperative.com
Your first months payment will be by direct bank transfer, all Payments from then are to be made by direct debit/standing order or go cardless and this must be set up within 7 days of your membership agreement, if this does not happen then you will not be allowed to attend any sessions or be refunded until it has been set up. Days missed due to this cannot be claimed back

5. Cancellation of Membership by Member
A member may cancel his/her membership at any time with a full 2 months membership notice period. If appropriate notice is not given the member will be charged a cancellation fee, which for the avoidance of doubt, shall be the equivalent of said notice period at which their membership has been agreed. Any member who suffers a physical disability that will prevent him or her from using the facility for more than six months will not be charged a cancellation fee as long as the cancellation is accompanied by a doctor's note documenting the injury and prognosis. Members may cancel memberships by notifying Crossfit imperative of their wish to cancel by E-mail to flynn@crossfitimperative.com, any time during business hours prior to the date of their membership agreement. There are no refunds for membership fees, and Crossfit imperative will not prorate a cancelled membership, I agree that this can be fully enforced by an outside agency should I fail to comply with this.

6. Attire
Appropriate footwear is highly recommended and required to train as a member of Crossfit imperative. Any barefoot lifting or running must be approved by the coach of the particular class and the management, and will be evaluated on a strict case by case basis. Crossfit imperative is not liable for any harm or injury due to deviations in the recommended standards of footwear.

7. Lost Articles
Crossfit imperative assumes no responsibility for lost or stolen articles. Lost and found articles not claimed will be donated to charity.

8. Smoking, Food and Drink.
No smoking is allowed in any part of the facility. Food or drink may be taken into workout areas if it is in a non-breakable, enclosed container.

9. Children
Members must be 16 years of age or older unless supervised by a parent or legal guardian at all times. Guest/Visitors under the age of 16 must be supervised by a parent or legal guardian at all times.


10. Conduct
Crossfit imperative is committed to the health, safety, welfare of each of its members and staff and will not tolerate unreasonable, threatening, obscene, harassing, indecent, or illegal behaviour. Crossfit imperative has the right to judge behaviour and respond accordingly. This right includes, but is not limited to, termination of membership of any member engaging in unacceptable behaviour.

11. Damages
Members shall pay for any damages to CrossFit imperative property which results from the wilful or negligent conduct of member, member's guest or dependent children.

12. Rules and/or Regulations
Members who do not observe CrossFit imperative rules and regulations or who abuse equipment in any fashion will be asked to leave. The management reserves the right to terminate membership to anyone who refuses to observe any of CrossFit imperative's rules or regulations. Not all rules and regulations are listed in this agreement. CrossFit imperative reserves the rights to add, change or remove rules, conditions of membership, opening and closing hours, and all services and facilities offered by Crossfit imperative at any time it deems necessary. 

13. Use of Photo and Video
CrossFit imperative, its representatives and employees the right to take photographs and videos of Member and Member's property whilst training with CrossFit imperative.

CrossFit imperative is authorised to use and publish these photos or videos in print and/or electronically. CrossFit imperative may use such photographs of Member with or without Member's name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and web content.

14. Miscellaneous
a. This Agreement contains the entire agreement between the parties, and supersedes any prior written or oral agreements between them concerning the subject matter of this Agreement. The provisions of this may be waived, altered, amended or repealed, in whole or in part, only upon prior written consent of all parties. This agreement shall be governed by the laws of the State of UK without regard to the principles of conflict of laws thereof and treated as a contract entirely made and executed within UK

b. Member has read, and fully agrees to the term of this Agreement and understands and agrees that by signing this Agreement (which contains a waiver, release and assumption of risks) Member has given up considerable future legal rights. Member has signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to him/her. Member certifies and warrants that he/she is 18 years of age or older and mentally competent to enter into this Agreement.
